Importing a Spare Engine with Your Classic Car: EPA Rules Explained

A customer recently asked us about importing a 1929 vehicle with a spare engine included in the shipment. The car qualified under the 25-year rule -- but the extra engine was a separate question entirely. Here is the short answer.

Is the Spare Engine Allowed? It Depends on When It Was Made

The vehicle and the spare engine are assessed separately at US customs. The car's 25-year exemption does not automatically cover a loose engine in the boot.

If the engine was made before January 1, 1968 (gasoline, light-duty):

It is excluded from EPA standards. Declare it on CBP Form 3520-1 under Code E. No compliance proof needed. For the 1929 example above, the engine cleared this way without issue.

Note: this pre-1968 exclusion applies to gasoline engines only. Diesel spare engines are subject to different thresholds, consult a licensed customs broker before including one in a shipment.

If the engine is newer than 1968 but over 21 years old:

It can still be imported, but only through one of these paths:

  • Code B: the engine has a US EPA emission label physically on the block

  • Code Y: the engine is identical to a US-certified unit, with documentation to prove it

  • Racing use only: with written EPA approval obtained before the shipment departs

If none of these apply, the engine likely cannot be imported. The practical solution is to leave it out of the shipment and source a compliant engine in the US after the vehicle arrives.

The One Thing to Do Before Your Shipment Leaves

Identify which code applies to your spare engine before booking. An undeclared engine discovered during customs inspection is treated as a compliance violation regardless of age. Getting the declaration right upfront takes a few hours. Resolving a customs hold takes weeks.
